psychoactivity tests<\/span><\/li><li><span style=\"font-weight: 400;\">  Custody of occupational medical records<br><br><\/span><\/li><\/ol><p><b>TO WHOM DOES IT APPLY?<\/b><\/p><p> <\/p><p><span style=\"font-weight: 400;\">Applies to ALL sectors and links:<\/span><\/p><p> <\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Employers (public and private)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Workers (dependent and self-employed)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contractors and contractors<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">ARL, IPS and OSH service providers<\/span><\/li><\/ul><p><br><br><\/p><p><b>KEY LIABILITIES<\/b><\/p><p><span style=\"font-weight: 400;\">Employers and contractors must:<\/span><\/p><p> <\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Assume EMO costs, travel expenses and inter-municipal transfers in case the EMO is held in another municipality.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Schedule EMO during business hours.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Implement labor adjustments no later than 20 working days after the EMO.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Deliver to the occupational physician:<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">-Position profile.<\/span><\/p><p><span style=\"font-weight: 400;\">-Epidemiological indicators.<\/span><\/p><p><span style=\"font-weight: 400;\">-IPEVR matrix.<\/span><\/p><p><span style=\"font-weight: 400;\">-Technical studies.<\/span><\/p><p><span style=\"font-weight: 400;\">-Biological indicators.<\/span><\/p><p> <\/p><p><b>TYPES OF EMO<\/b><\/p><p><span style=\"font-weight: 400;\">Occupational medical evaluations (OME)<\/span><\/p><p> <\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pre-entry<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Periodic scheduled<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Periodic due to change of occupancy of exit<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Post-disability (+30 days)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For return to work (+90 days)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Follow-up or control<\/span><\/li><\/ul><p> <\/p><p><b>TYPES OF EMO<\/b><\/p><p><span style=\"font-weight: 400;\">Frequency<\/span><\/p><p> <\/p><p><span style=\"font-weight: 400;\">Max. every 3 years, with technical justification and according to exposure to actual and potential risks. <\/span><\/p><p><b>Prohibited unless justified<\/b><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pregnancy test<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">HIV test<\/span><\/li><\/ul><p> <\/p><p><span style=\"font-weight: 400;\">Note: if the worker rejects the EMO, there will be repercussions for the employee in the event that he\/she rejects the EMO.<\/span><\/p><p><span style=\"font-weight: 400;\">to the performance of the position, when there is a risk that affects the<\/span><\/p><p><span style=\"font-weight: 400;\">substantially.<\/span><\/p><p> <\/p><p><b>ALCOHOL AND PSYCHOACTIVE TESTS<\/b><\/p><p><span style=\"font-weight: 400;\">When to apply tests?<\/span><\/p><p> <\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To prevent occupational accidents and diseases<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Activities with risk or liability to third parties<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Must be justified in the OSHMS.<\/span><\/li><\/ul><p> <\/p><p><b>Requirements<\/b><\/p><p> <\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Test applied only by OSH licensed medical personnel.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Calibrated equipment<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Training is custody and handling of evidence<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Follow Resolution 1844\/2015 (Quality assurance system).<\/span><\/li><\/ul><p><br><br><\/p><p><b>ALCOHOL AND PSYCHOACTIVE TESTS<\/b><\/p><p><span style=\"font-weight: 400;\">Employer must:<\/span><\/p><p> <\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Encourage treatment if positive<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Include consumption prevention campaigns in the OSHMS.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To have a policy and program for the prevention of drug dependence.<\/span><\/li><\/ul><p> <\/p><p><b>OCCUPATIONAL MEDICAL RECORDS<\/b><\/p><p><span style=\"font-weight: 400;\">Confidentiality and custody<\/span><\/p><p> <\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The employer may NOT keep it without the worker&#8217;s authorization or without a doctor trained in OSH.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Custodian: occupational physician or authorized IPS minimum age: 20 years.<\/span><\/li><\/ul><p> <\/p><p><b>Implementation period<\/b><\/p><p><span style=\"font-weight: 400;\">6 months for employers and health care providers<\/span><\/p><p>
