TO WHOM DOES IT APPLY?
Applies to ALL sectors and links:
- Employers (public and private)
- Workers (dependent and self-employed)

- ARL, IPS and OSH service providers
KEY LIABILITIES
Employers and contractors must:
- Assume EMO costs, travel expenses and inter-municipal transfers in case the EMO is held in another municipality.
- Schedule EMO during business hours.
- Implement labor adjustments no later than 20 working days after the EMO.
- Deliver to the occupational physician:
-Position profile.
-Epidemiological indicators.
-IPEVR matrix.
-Technical studies.
-Biological indicators.
TYPES OF EMO
Occupational medical evaluations (OME)
- Pre-entry
- Periodic scheduled
- Periodic due to change of occupancy of exit
- Post-disability (+30 days)
- For return to work (+90 days)
- Follow-up or control
TYPES OF EMO
Frequency
Max. every 3 years, with technical justification and according to exposure to actual and potential risks.
Prohibited unless justified
- Pregnancy test
- HIV test
Note: if the worker rejects the EMO, there will be repercussions for the employee in the event that he/she rejects the EMO.

ALCOHOL AND PSYCHOACTIVE TESTS
When to apply tests?
- To prevent occupational accidents and diseases
- Activities with risk or liability to third parties
- Must be justified in the OSHMS.
Requirements
- Test applied only by OSH licensed medical personnel.
- Calibrated equipment
- Training is custody and handling of evidence
- Follow Resolution 1844/2015 (Quality assurance system).
ALCOHOL AND PSYCHOACTIVE TESTS
Employer must:
- Encourage treatment if positive
- Include consumption prevention campaigns in the OSHMS.
- To have a policy and program for the prevention of drug dependence.
OCCUPATIONAL MEDICAL RECORDS
Confidentiality and custody
- The employer may NOT keep it without the worker’s authorization or without a doctor trained in OSH.
- Custodian: occupational physician or authorized IPS minimum age: 20 years.
Implementation period
6 months for employers and health care providers
