New regulations on Occupational Safety and Health: what you should know about resolution 1843 of 2025

Changes in:

  1. Occupational medical evaluations (OME)
  2. Breathalyzer, alkalimetry and psychoactivity tests
  3. Custody of occupational medical records

TO WHOM DOES IT APPLY?

Applies to ALL sectors and links:

  • Employers (public and private)
  • Workers (dependent and self-employed)
  • Contractors and contractors
  • ARL, IPS and OSH service providers



KEY LIABILITIES

Employers and contractors must:

  • Assume EMO costs, travel expenses and inter-municipal transfers in case the EMO is held in another municipality.
  • Schedule EMO during business hours.
  • Implement labor adjustments no later than 20 working days after the EMO.
  • Deliver to the occupational physician:

-Position profile.

-Epidemiological indicators.

-IPEVR matrix.

-Technical studies.

-Biological indicators.

TYPES OF EMO

Occupational medical evaluations (OME)

  • Pre-entry
  • Periodic scheduled
  • Periodic due to change of occupancy of exit
  • Post-disability (+30 days)
  • For return to work (+90 days)
  • Follow-up or control

TYPES OF EMO

Frequency

Max. every 3 years, with technical justification and according to exposure to actual and potential risks.

Prohibited unless justified

  • Pregnancy test
  • HIV test

Note: if the worker rejects the EMO, there will be repercussions for the employee in the event that he/she rejects the EMO.

ALCOHOL AND PSYCHOACTIVE TESTS

When to apply tests?

  • To prevent occupational accidents and diseases
  • Activities with risk or liability to third parties
  • Must be justified in the OSHMS.

Requirements

  • Test applied only by OSH licensed medical personnel.
  • Calibrated equipment
  • Training is custody and handling of evidence
  • Follow Resolution 1844/2015 (Quality assurance system).



ALCOHOL AND PSYCHOACTIVE TESTS

Employer must:

  • Encourage treatment if positive
  • Include consumption prevention campaigns in the OSHMS.
  • To have a policy and program for the prevention of drug dependence.

OCCUPATIONAL MEDICAL RECORDS

Confidentiality and custody

  • The employer may NOT keep it without the worker’s authorization or without a doctor trained in OSH.
  • Custodian: occupational physician or authorized IPS minimum age: 20 years.

Implementation period

6 months for employers and health care providers

ILO approves inclusion of occupational safety and health as a fundamental right at work.

2022

During the first week of the 110th Session OF 2022 of the International Labor Conference of the International Labor Organization (ILO), held in Geneva, Switzerland, the Committee on General Affairs managed the approval of the INCLUSION OF SAFETY AND HEALTH AT WORK AS A PRINCIPLE AND FUNDAMENTAL RIGHT AT WORK. In this important advance for labor law, Dr. Belisario Velásquez Pinilla participated directly as delegate of the Colombian State to the ILO for the United Nations as Technical Advisor to the Committee on General Issues on Safety and Health at Work.

Orly Torres is a Business Administrator graduated from the Universidad Politécnico Gran Colombiano with more than 20 years of work experience working in public and private sector organizations, in the production of services or production of goods, national and international, operations and logistics.

John Albert Gomez

Vice President

John Albert is a lawyer, Master in Law with specialization in Procedural Law, specialist in Social Security Law, Procedural Legal Institutions and Occupational Health Management. It is licensed to provide Occupational Health and Safety services, and is certified as an auditor in technical standards related to Quality Systems, Environmental Management and Occupational Health and Safety (OSH). He has more than twenty years of professional experience.

As a lawyer of the company Belisario SAS, he provides strategic services, including judicial and extrajudicial representation, labor consulting and advice, as well as legal services in occupational health and safety. In addition, he advises on employer’s liability issues regarding the occurrence of occupational accidents and occupational diseases in recognized companies.

John Albert also has extensive experience in collective bargaining, actively participating in negotiation tables and in strategic interventions for the resolution of collective conflicts.

He is distinguished for his leadership skills and for guiding the work teams towards the fulfillment of the company’s strategic objectives. It is recognized for providing immediate, timely and high quality service.

Belisario Velasquez Pinilla

Chairman

President, lawyer, advisor and litigator of Belisario Velásquez & Asociados, with more than 35 years of experience. Doctor and Master in Law, and in Prevention and Protection of Labor Risks. Specialist in labor law, occupational health, liability and compensable damages, evidentiary and procedural law.

He is a technical advisor to the Colombian government before the ILO, participating in the elaboration of conventions on occupational safety and health (OSH) and labor law. He chairs the USN 09 Committee of ICONTEC, contributing in ISO OSH management standards.

Postgraduate lecturer in labor law and OSH at Universidad Nacional, U. del Rosario, U. de Antioquia and UIS.
